BulwarkCS is a cybersecurity company registered in the United Kingdom that provides a range of security services to organisations to protect against cyber threats.

If you are using our Services on behalf of a company, organisation, or other entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

4. Eligibility

To use our Services, you must:

  • Be at least 18 years old or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into a binding contract with BulwarkCS
  • Not be prohibited from using our Services under applicable laws

If you are using our Services on behalf of an organisation, you represent and warrant that your organisation is legally registered and operates in compliance with applicable laws.

5. User Accounts

Some of our Services may require you to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Be responsible for all activities that occur under your account

We reserve the right to disable any user account if, in our opinion, you have violated any provision of these Terms.

6. Intellectual Property Rights

The Services and all content, features, and functionality, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by BulwarkCS, its licensors, or other providers of such material and are protected by UK and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any rights to use our trademarks, logos, domain names, or other distinctive brand features without our prior written consent.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your internal business purposes.

Your Content

You retain all rights to any content you submit, post, or display on or through the Services ("Your Content"). By providing Your Content to us, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute Your Content in any and all media or distribution methods solely for the purpose of providing and improving our Services.

7. User Conduct

You agree not to use our Services:

  • In any way that violates any applicable law or regulation

  • To test the vulnerability of our systems or networks without explicit prior written authorisation

  • To conduct security assessments or testing on systems or networks for which you do not have explicit permission to do so

8. Payment Terms

Fees for our Services will be specified in a separate service agreement or statement of work. Unless otherwise stated:

  • All fees are quoted in Pound Sterling (GBP) and are exclusive of VAT or other applicable taxes
  • Payment is due within 30 days of invoice date
  • Late payments may incur a fee of 2% per month or the maximum amount allowed by law
  • You are responsible for all taxes applicable to the Services

If you dispute any charges, you must notify us in writing within 14 days of the invoice date.

9. Confidentiality

During the provision of our Services, each party may disclose or make available to the other party information that is confidential or proprietary ("Confidential Information"). Confidential Information includes any information that is marked or identified as confidential, or that would reasonably be understood to be confidential given the nature of the information and the circumstances of disclosure.

Each party agrees to:

  • Protect the other party's Confidential Information with the same standard of care it uses to protect its own Confidential Information, but in no event less than reasonable care
  • Not disclose or use the other party's Confidential Information for any purpose outside the scope of these Terms without prior written permission
  • Limit access to the other party's Confidential Information to those of its employees, contractors, and agents who need such access for purposes consistent with these Terms and who have signed confidentiality agreements with similar protections

Confidentiality obligations shall survive the termination of these Terms for a period of five (5) years.

10. Limitation of Liability

To the maximum extent permitted by law:

  • In no event shall BulwarkCS, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
  • Our total liability to you for all claims arising under or in connection with these Terms shall be limited to the total fees paid by you to us during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury resulting from our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited by English law

11. Disclaimers and Warranties

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. However, there are certain things that we do not promise about our Services.

Other than as expressly set out in these Terms, we do not make any specific promises about our Services. For example, we don't make any promises about:

  • The specific functions of our Services, or their reliability, availability, or ability to meet your needs
  • That our security services will detect all vulnerabilities or prevent all security breaches
  • That our recommendations will eliminate all security risks

We warrant that:

  • We will perform the Services with reasonable skill and care in accordance with industry standards
  • We have the necessary skills, expertise, and resources to provide the Services
  • We will comply with all applicable laws and regulations in the provision of the Services

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account or service agreement, you may simply discontinue using the Service or contact us using the information provided below.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and updating the "Last Updated" date at the top of this page.

Your continued use of our Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, please stop using the Services.
